Scope of Services
I will attempt to diagnosis and repair your computer problem.  Upon evaluating the issue, if I find that support may not be completed due to a problem with your computer or its configuration that is beyond my control, I will provide you with options and or suggestions to resolving any technical issues. However if you do not find any of our options or suggestions suitable, I will not be liable for the damages or corruption of parts or data

Customer Liabilities
 
You understand and agree that prior to contacting or allowing me to diagnose and or repair your computer, it is your responsibility to back-up the data, software, information or other files stored on your computer disks and or hard drives. You acknowledge and agree that Aplus Computer Aid (aka, me) shall not be responsible under any circumstance for any loss or corruption of data and or software you have failed to back up.

Limitations of Service
I reserve the right to cease from providing any or all requested computer services and instead refund your payments in full or partial, based upon needs that are unreasonable or go beyond my scope of support. I trust that the customer is well instructed on the use of their software and or computer equipment.  Aplus Computer Aid is not liable for your misuse of your computer equipment and or software.

Warranty
I do not warranty my services. However, in the event that you are not satisfied with any of the services that I have provided you with, and you contact me within 48 hours, I will reasonably work with you toward finding an adequate solution to remedy the situation.

WAIVER OF LIABILITY

I, ______________________________________, grant permission to Aplus Computer Aid to perform any action they deem necessary to attempt to repair my computer. I understand that this procedure is an attempt towards the repair of my computer which could result in loss of part, or all, of the data stored thereon and that Aplus Computer Aid makes no warranty or guarantee as to the success of its attempts. Furthermore, I release Aplus Computer Aid from any liability for any data loss which may occur during, or as a result of, this procedure.

ALL CLAIMS FOR LIABILITY AND/OR LOSS INCLUDING WITHOUT LIMITATION ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHICH MAY OCCUR AS A RESULT OF ANY ACTION (OR INACTION) ARE HEREBY EXPRESSLY WAIVED.

I also understand that, even if the data is successfully recovered, there is a possibility that
individual files and directories on the disk may still be inaccessible due to wear and tear of the media and/or other technical reasons.

Statement on Viruses, Malicious Software and Associated Services

Overview

I am quite experienced at the detection and removal of viruses, trojans and other malicious software. The exact nature of this service is subject to constant change, as the type of threats and the software tools available are updated on a continual basis.

Risks
Damage to Files or Operating Systems: Generally, the processes used to identify and remove malicious software involve deleting or modifying files on the your computer. Because malicious software usually attempts to take control of or modify a system at the lowest level possible, this often means that virus scanning and removal often must interact with critical system files on the computer. Virus removal is an attempt to restore the customer’s computer to a safe, usable state, rather than needing to completely re-install the operating system and applications. It is not always successful, and professional, appropriate and thorough virus removal efforts may still result in a customer computer with an unrecoverable, non-function or non-bootable state. Customer should be aware, before requesting virus or malicious software services, of this possibility and the limitations of further support from Aplus Computer Aid. Specifically, the customer should be aware that I may not be able to offer Operating System installation or re-installation,  even if virus or malicious software attempts appear to have left the customer computer in a less useable state.

Re-infection or Continued Presence of Malicious Software: Even after a successful or apparently successful removal of all viruses or malicious software from a machine, there is no assurance that the system will not be re-infected with malicious software within a short period of time, following the removal. This re-infection may have an external source, or re-establish the infection from files still remaining on the computer.

External Sources:
Vectors for virus or malicious software infection have been identified in many devices, applications and services that a customer could easily come into contact with, on a day to day basis, that are outside the control of Aplus Computer Aid, which can not anticipate re-infection, give a comprehensive list of possible sources or offer any service to inoculate the user’s machine from possible infection. A small selection of possible sources can include:
* Websites, including those generally considered “legitimate” (media outlets, major search engines, social networking sites, etc.)
* Downloaded files or applications.
* Flash drives or other storage media
* Connection to wireless networks

Local Sources:
The detection and removal tools used by me are not universally effective, nor are any claims made to this effect, as there are no such things - however, I do use the best, most up-to-date methods and tools currently available. Even an apparently successful removal, which leaves no outward signs of infection or unwanted behavior, may fail to remove files or data which are capable of re-establishing an infection on the your computer. These files may reside in locations that it is difficult for anyone to inspect with any tools at their disposal, such as the non-data storage areas of your hard disc drive.

Re-imaging or re-installation of the operating system (with, at minimum, disc re-formatting) remains the only method of removal with which I, or you, the customer, can be reasonably sure that no local sources of re-infection remain.
